1. General Provisions
1.1. The following terms and conditions of sale apply to the offer and purchase of products through the website www.bluebluechihuahua.com.
1.2. In order to buy products on the Website, customers must a) be at least 18 years old, or if they are minors, be authorized by their legal guardian, b) be consumers, understood as such natural persons acting for purposes beyond their control. industry, trade, business and profession, and c) register on the website.
1.3. This contract is formalized in Spanish and is regulated by Spanish legislation according to Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users, and other complementary laws. , approved by Royal Legislative Decree 1/2007, of November 16, and Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce ("LSSI").
2.1. Information about the products is available on the Website, which is provided in accordance with articles 60, 63, 97 of the Consumer Law and articles 27 and 28 of the LSSI.
2.2. The products described in www.bluebluechihuahua.com and the samples of the same that, where appropriate, we will provide the client are exclusively for personal use. Customers may not sell or resell such products or samples. The company Blueblue Chihuahua reserves the right, with or without notice, to cancel or reduce the number of products or samples to be delivered to the customer when, at our sole discretion, it involves a breach of these Terms and Conditions of Sale.
All prices indicated for the products that are available through the Website include VAT at current rates and are denominated in euros. 6. Gift Packaging Service
6.1. Blueblue Chihuahua always treats all requests with care. We will be happy to create a nice package for your gift. The Gift Wrapping Service is free for the customer.
6.2. If the customer wants their order to be gift-wrapped, they will simply have to select in the delivery options, gift delivery or if they would like specific packaging for Christmas, Christmas gift delivery. Currently, customers cannot include a card with a personal message. If it is not available in the shipping options, please add an order note at the end of the shipping and billing address data.
6.3. In the event that a gift packaging request covers more than one product, we will create a gift package for each of them.
7. Offer Codes
7.1. To redeem an offer code, the customer must enter it in the section Do you have a coupon? during the checkout process. Offer codes are case sensitive and should always be entered exactly as they appear.
7.2.When an offer code is accepted, the offer will be displayed in “Order Review”
7.3. One offer code may be used per order.
8. Payment Options
8.1. The customer can pay for Blueblue Chihuahua products by credit card, debit card, Pay-Pal or bank transfer. The following credit and debit cards are accepted for this purpose:
8.2. If you place your order by bank transfer, Blueblue Chihuahua will not make your shipment until it has received the full amount in your account.
8.3. The products will not be charged to the customer until they are shipped.
8.4. All credit and debit card holders are subject to validation and authorization checks by the card issuer. If the issuer of the customer's payment card denies, or for any reason does not authorize the payment in our favor either before or after a payment, we will not be responsible for any delay or non-delivery.
9. Inquiries about Orders
9.1. Products are generally shipped several days after receipt of an order. To obtain information about a shipment, the customer must contact us by email at the following address: firstname.lastname@example.org or consult the purchase guide on the web.
9.2. With a Blueblue Chihuahua account, customers can check the status of their most recent orders by visiting the Order Status page in My Account. This is the easiest and fastest way to get the most up-to-date information regarding orders.
9.3. When the customer clicks on the Order Status page, they will be asked to log in with their email address and password. Your current and previous orders will be detailed on the order summary page. Once the order has been shipped, the corresponding tracking number will be displayed, if available. Customers can track the delivery of their order through the code that Blueblue Chihuahua will provide them once their order has been shipped, through the corresponding courier company. Some carriers may not have tracking information available after 24 hours of order shipment.
9.4. Occasionally our system cancels orders or parts of an order for various reasons. Some reasons are:
-Cancellation at the request of a client
-Formulation of an order in duplicate
-Impossibility of delivering to the address provided
-Unable to process payment information
-Items not available
9.5. If an order is cancelled, the customer will receive an email explaining the reasons for the cancellation. The customer will not be charged for canceled orders. If the customer is interested in making a new order or if he has any questions about a canceled order, he can contact us by email at the following address: email@example.com.
10.1. Orders are processed and delivered exclusively on business days (Monday to Friday, not including holidays). Orders placed on Saturday and Sunday will be processed the next business day.
10.2. We cannot process orders with a delivery address in a post office box.
10.3. Shipping costs will be borne by the customer, if any, and are indicated separately on the order form and on the delivery note.
10.4.In accordance with Article 103 of the Consumer Law, the products will be delivered up to 3 days with free cost. Delivery will be valid within 30 (thirty) days after the order is placed by the customer, unless within the same term we notify the customer, even by email, in the same period, that the ordered products are not available, even that they are temporarily unavailable.
10.5. Shipments will not be made to Ceuta and Melilla.
11. Right of Withdrawal
11.1. We are committed to offering customers our best products. If the client considers that the products he has received do not meet this expectation, in accordance with article 71 of the Consumer Law, he will have the right to withdraw from the contract, without giving any reason, within 14 (fourteen) calendar days following the date of receipt of the products.
11.2. The customer may notify his intention to exercise the right of withdrawal by sending us an email to hola@bluebluechihuahua with the details of the relevant order, including the customer's order number and the description of the products subject to the return. Inside the order packaging, the customer will find a delivery note with details of the order and details about our return procedure. If the products listed in the shipping note do not match those delivered, the customer must notify us immediately by email to hola@bluebluechihuahua.
11.3. The Blueblue Chihuahua Customer Service department will then issue the customer an authorization number and a confirmation by email. The customer is invited to save his authorization number for future consultation with the Customer Service department in this regard.
11.4. In the event that the customer returns products for reasons other than that they are defective or that their delivery was incomplete or incorrect, they must arrange their return.
11.5. In the event of exercising the right of withdrawal, we undertake to reimburse the customer for the price of the products within fourteen (14) calendar days following the date on which we receive your communication of withdrawal, provided that the products are returned by the customer and at his expense, unused and undamaged, having been maintained and handled with due care and attention, within 14 calendar days following the date of communication of his withdrawal. We reserve the right to withhold the refund to the customer until we have received the returned products.
12. Absence of Conformity
12.1. In case of lack of conformity of the products with the contract in accordance with the provisions of article 116 of the Consumer Law, the guarantees established in articles 118 to 122 of the same law will apply. The customer has the right to have the products repaired or replaced, free of charge, so that they are in accordance with the contract, failing which the customer is entitled to an appropriate reduction in the price of the products or to cancel the contract. The client waives the rights described above in the event that he does not notify us of the lack of conformity within the two months following the date on which he detected it. We will be liable for the lack of conformity when it becomes apparent within two years of the delivery of the products. In any event, actions brought in connection with a non-conformity not maliciously concealed by us will automatically expire thirty-six months after delivery of the products.
13. Applicable Law and Jurisdiction
13.1.These Terms and Conditions are regulated by Spanish law and must be interpreted in accordance with Spanish law
13.2. The conflicts that, where appropriate, cause the interpretation, validity and/or execution of these Terms and Conditions will be submitted to the jurisdiction of the courts and tribunals of the place of residence or domicile of the client.
